Terms of Service

1. Acceptance of Terms

By accessing and using Blosstr's file hosting and sharing services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. User Content and Uploads

2.1 Prohibited Content

You agree NOT to upload, store, or share:

• Copyrighted material without permission
• Illegal content of any kind
• Malware, viruses, or harmful code
• Content that infringes on others' intellectual property rights
• Content that violates any applicable laws or regulations
• Content that is defamatory, harassing, or threatening
• Pornographic or sexually explicit content
• Content involving minors without proper consent

2.2 Content Responsibility

You are solely responsible for the content you upload and share. Blosstr does not monitor, review, or verify the content uploaded by users. You must ensure that:

• You have the right to upload and share the content
• The content does not violate any laws or regulations
• The content does not infringe on others' rights

3. Service Usage

3.1 Acceptable Use

You agree to use Blosstr's services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use the service to distribute spam or unsolicited content
• Exceed reasonable usage limits
• Use Blosstr to host image libraries you link to from elsewhere, content for your website, advertising, avatars, or anything else that turns us into your content delivery network
• Hotlink to adult content or to file-sharing, gambling, torrent, warez, or rip-off sites
• Impersonate someone else
• Use Blosstr for any type of illegal money transmission

3.2 Service Availability

Blosstr strives to provide reliable service but does not guarantee uninterrupted access. We may temporarily suspend or terminate service for maintenance, security, or other reasons.

4. Intellectual Property

4.1 Your Content

You retain ownership of your content. By uploading files, you grant Blosstr a limited license to host and serve your content as part of our service.

4.2 Limited License to Us

You grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to host, store, transfer, display, adapt, perform, reproduce, modify, translate, and distribute your User Content (in whole or in part) in any media formats and through any media channels (now known or hereafter developed). You understand that we will not pay you for any use of your content and that your content may be made available to the public for their use without providing you attribution or compensation.

4.3 Use of Blosstr Content

By downloading content or copying other user-generated content from Blosstr, you agree that you do not claim any rights to it. The following conditions apply:

• You may use UGC for personal, non-commercial purposes
• You may use UGC for anything that qualifies as fair use under copyright law, but please include attribution ("Blosstr" or "courtesy of Blosstr")
• You may not use UGC for non-journalistic commercial purposes
• Your use of UGC is at your own risk

4.4 Our Service

Blosstr's service, including its software, design, and content, is protected by intellectual property laws. You may not copy, modify, or distribute our service without permission.

5. Privacy and Data

We respect your privacy and handle your data in accordance with our Privacy Policy. We do not sell your personal information to third parties.

6. Limitation of Liability

Blosstr provides its service "as is" without warranties. We are not liable for any damages arising from your use of our service, including but not limited to:

• Loss of data or content
• Service interruptions
• Security breaches
• Third-party actions

7. Termination

We may terminate or suspend your access to our service at any time, with or without notice, for violation of these terms or for any other reason.

8. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of significant changes, but it is your responsibility to review the terms periodically.

10. Arbitration and Dispute Resolution

You and we agree to resolve any and all disputes with binding individual arbitration before a single arbitrator. Class action lawsuits, class-wide arbitrations, and other representative proceedings are not permitted. The arbitrator's decision will be final except for a limited right of review.

10.1 Arbitration Procedure

To initiate an arbitration, you must submit a Demand for Arbitration to admin@blosstr.com. Any hearing for disputes involving $25,000 or less will be telephonic or by videoconference unless the arbitrator finds good cause to hold an in-person hearing.

10.2 Small Claims Court Exception

Instead of proceeding with arbitration, either you or we may sue the other party in small claims court seeking only individualized relief, so long as the action meets the small claims court's requirements.

11. DMCA and Copyright Infringement

If you believe that content on our service infringes your copyright rights, you may notify us by sending the following information to admin@blosstr.com:

• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing
• A statement that you have a good faith belief that use of the material is not authorized
• A statement that the information is accurate and that you are authorized to act on behalf of the copyright owner
• Your contact information

11.1 Repeat Infringers

If we identify you as a "repeat infringer," we will block or remove your media and terminate any accounts you have with us. We reserve the right to remove any content at any time whether or not it infringes or violates any of our policies.

12. Disclaimer of Warranties and Limitation of Liability

Blosstr's services are provided on an "AS IS – WITH ALL FAULTS" basis. Your use of our service is entirely at your own risk. We do not guarantee the availability of our service at any given time, or the reliability of our service when it is running.

12.1 No Warranties

Blosstr DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF FITNESS AND MERCHANTABILITY. We do not assume responsibility for the accuracy, appropriateness, or harmlessness of any content appearing on our service.

12.2 Limitation of Liability

Blosstr WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF, OR INABILITY TO USE, OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12.3 Indemnification

You will indemnify and hold Blosstr and all of its personnel harmless from all loss, liability, claims, damages and expenses, including reasonable attorney fees, arising out of or related to your violation of these Terms, your infringement of any third party's rights, and any harm caused to any third party as a result of your uploading of files or content to our servers.

13. Age Restrictions

Blosstr is not meant for use by people under age 18. If you are younger than 18, please use our service only under adult supervision. Parental control protections are commercially available that may assist you in limiting access to material that is harmful to minors.

14. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the jurisdiction where Blosstr operates. Any disputes will be resolved in accordance with applicable laws. If any part of these terms is invalid, the remaining provisions will be unaffected.

15. Changes to Terms

We may revise these terms from time to time without notice. Whenever we do so, we will indicate by changing the version date at the top. Any changes apply as of the time they are posted. These Terms of Use constitute the entire agreement among the parties relating to this subject matter, and they will continue to govern any issues that arise out of your use of Blosstr's services even after you discontinue using them.
